PERSONAL INJURY CASES
Traumatic brain injuries as the result of motor vehicle accidents, falls, assaults and medical events may leave people with enduring cognitive problems. This can impact on their everyday activities, ability to work and study. Neuropsychological assessment involving the use of well validated and robust psychometric tests provides objective assessment of these difficulties.
CAPACITY
A range of different brain disorders including traumatic brain injuries and neurological illnesses such as dementia can cause changes to an individual's cognitive function and may impact on their capacity to make decisions in day-to-day life. Such decisions could be about a range of matters including:
-Decisions about lifestyle or financial matters
-Capacity to make Enduring Powers of Attorney or to appoint a Medical Treatment Decision Maker
-Testamentary Capacity
-Capacity to carry out the role of parent
-Capacity to participate effectively in legal proceedings
A neuropsychological assessment can help to provide evidence regarding an individuals capacity to understand their circumstances and to make informed decisions about the issues in question. Ultimately, however, it is up to a court to decide whether or not an individual is competent to make decisions and any need for a substitute decision maker (e.g., a Guardian or Financial Administrator) in the particular circumstances.
